The founding fathers of the constitution were of the belief that, the government had certain limits, and it should be the protector of the rights of individuals, and the people should exercise their right of trail by jury freely.
George Washington, John Adams, Benjamin Franklin, Thomas Jefferson, Alexander Hamilton, John Jay along with James Madison, were considered as the founders of the American Constitution.
According to them, the individual rights of people, should be protected by the Habeas Corpus law,
where people had right to trial by jury, and it is not an essential part, the individual rights, to be assessed individually in the constitution.
The founding members had assessed a greater power, in which hey themselves had bypassed the state legislatures, and called for a consent of all the states in an convention, where it was proposed to all.
There were 13 states, of which, the States had given their consent, initially, in the favor of the constitution and later the other states had also approved the proposal.
